Pasco County Florida Swingers Club shutdown by Sheriffs Office

PORT RICHEY -- Pasco County's most notorious swingers club has thrown its last erotic party.

Club Elite owners Eric and Angie Kubb settled a lawsuit with Pasco County over the club, where members engaged in open sex acts and bondage shows. The settlement requires them to shut down the club by July 22 and prohibits the owners from marketing the bottle club to swingers. The settlement was approved by county commissioners Tuesday.

The club's website says the last party was held June 4.

The club, which opened in 2007, was on the second floor of the West Port Plaza strip mall on U.S. 19. The club promoted itself as an upscale atmosphere that catered to "sensually erotic couples and singles."

Since the beginning, complaints poured in to the Pasco County Sheriff's Office, which launched a six-month investigation. Undercover detectives said they saw couples having sex on multiple occasions. At one point, a male detective was asked to participate in a wet T-shirt contest, and the female officer was dared to change into the shirt.

In 2009, the county filed a suit against the club and its owners, asking a judge to find Club Elite in violation of zoning codes, arguing that it was a sexually oriented business in an area not zoned for one.

Adult businesses are only permitted in property zoned for industrial use, Assistant County Attorney Kristi Wooden said. Though county officials have received reports of other swingers events, Club Elite was the only established club for swingers, she said.

The club can continue to operate as a bottle club, Wooden said.

The owners agreed to dismantle the club's interior rooms and "remove all mattresses, sheets and pillows from the property."

In addition to Club Elite and the Kubbs, the suit named W.J. Investments, which owns the property; S&G Investments of Hernando County Inc., which owns the liquor license used by Club Elite; and Susan Panesso, who also was listed as an owner.

They are not entitled to reimbursement for legal fees.
